The provisions of this title shall preempt any State law, rule, or regulation only to the extent that such State law, rule, or regulation conflicts with a provision of this title. Nothing in this title shall be construed to prohibit a State from enacting a law, rule, or regulation that provides greater protection to children or teens than the protection provided by the provisions of this title. Nothing in this title shall be construed to— affect the application of— section 444 of the General Education Provisions Act ( 20 U.S.C. 1232g , commonly known as the Family Educational Rights and Privacy Act of 1974 ) or other Federal or State laws governing student privacy; or the Children’s Online Privacy Protection Act of 1998 ( 15 U.S.C. 6501 et seq. ) or any rule or regulation promulgated under such Act; or authorize any action that would conflict with section 18(h) of the Federal Trade Commission Act ( 15 U.S.C. 57a(h) ).
