Notwithstanding any other provision of law, the unobligated balances of funds made available in division J of the Infrastructure Investment and Jobs Act ( Public Law 117–58 ) to any department or agency funded by this or any other Act may be transferred to the United States Fish and Wildlife Service and the National Marine Fisheries Service for the costs of carrying out their responsibilities under the Endangered Species Act of 1973 ( 16 U.S.C. 1531 et seq. ) to consult and conference, as required by section 7 of such Act, in connection with activities and projects funded by Public Law 117–58 :
That such transfers shall support activities and projects executed by the department or agency making such transfer: Provided, That such transfers shall be approved by the head of such department or agency making such transfer: Provided further, , That each department or agency shall provide notification to the Committees on Appropriations of the House of Representatives and the Senate no less than 30 days prior to such transfer: Provided further That any such transfers from the Department of Transportation, including from agencies within the Department of Transportation, shall be from funding provided for personnel, contracting, and other costs to administer and oversee grants:
Provided further, That amounts transferred pursuant to this section shall be in addition to amounts otherwise available for such purposes: Provided further, That the transfer authority provided in this section shall be in addition to any other transfer authority provided by law: Provided further, That amounts transferred pursuant to this section shall continue to be treated as amounts specified in section 103(b) of division A of Provided further, Public Law 118–5 .
