In this title: The term commercially available information means information that is— of a type customarily made available or obtainable, sold, leased, or licensed to members of the general public or to non-governmental entities for purposes other than governmental purposes; or intended for exclusive government use; and knowingly and voluntarily provided by, procured from, or made accessible by a non-governmental entity. The term open-source intelligence means intelligence derived exclusively from publicly available information or commercially available information.
The term publicly available information means information that— is published or broadcast for public consumption; is available on request to the public, including information available by subscription or purchase; is accessible by the public; could be seen or heard by any casual observer or member of the public; is made available at a meeting open to the public; or is observed by visiting any place or attending any event that is open to the public.
