Title III of the Help America Vote Act of 2002 ( 52 U.S.C. 21081 et seq. ) is amended— by redesignating sections 305 and 306 as sections 306 and 307, respectively; and by inserting after section 304 the following new section: To the extent that a State or local jurisdiction has a voter identification requirement, the State or local jurisdiction shall treat a student identification card issued by an institution of higher education that contains the minimum identifying information required for any other eligible form of voter identification as meeting such voter identification requirement.
For purposes of this section, the term institution of higher education has the meaning given that term in subsections
(a)and
(b)of section 101 and subsections
(b)and
(c)of section 102 of the Higher Education Act of 1965 ( 20 U.S.C. 1001(a) , 1001(b), 1002(b), 1002(c)). . Section 401 of such Act ( 52 U.S.C. 21111 ) is amended by striking and 304 and inserting , 304, and 305 . The table of contents of such Act is amended— by redesignating the items relating to sections 305 and 306 as relating to sections 306 and 307, respectively; and by inserting after the item relating to section 304 the following new item: Sec. 305. Treatment of student identification cards as voter identification. .
