None of the funds made available by this Act may be used to implement a regulation issued by the State of California, pursuant to the authority provided under the 2009 Memorandum of Agreement between the California Department of Toxic Substances Control and Region IX of the Environmental Protection Agency (or any successor agreement), to regulate metal shredding facilities in a manner that is inconsistent with or in any respect different from the requirements of the Solid Waste Disposal Act ( 42 U.S.C. 6091 et seq. ).
