None of the funds made available by this or any other Act may be used to modify, rescind, or grant waivers from the preemption determinations published by FMCSA at 83 FR 67470 (Dec. 28, 2018) and 85 FR 73335 (Nov. 17, 2020). Notwithstanding 49 U.S.C. 31141(d)(2) , the Secretary shall deny, without a hearing on the record, any petitions for waiver of the aforementioned preemption determinations pending on the date of enactment or received after the date of enactment.
