In addition to amounts otherwise available, there is appropriated to U.S. Immigration and Customs Enforcement for fiscal year 2025, out of any money in the Treasury not otherwise appropriated, $20,000,000 to remain available until September 30, 2029, for the purposes described in subsection (b). The funds made available under subsection
(a)shall only be used to— maintain the care and custody, during the period in which the charges described in subparagraph
(A)are pending, of an alien who— is charged only with a misdemeanor offense under section 275(a) of the Immigration and Nationality Act ( 8 U.S.C. 1325(a) ); and entered the United States with the alien’s child who has not attained 18 years of age; and detain the alien with the alien’s child.
