Section 106 of the Federal Water Pollution Control Act ( 33 U.S.C. 1256 ) is amended by striking subsections
(b)and
(c)and inserting the following: Of the amounts made available to carry out this section for each fiscal year, the Administrator shall— subject to paragraph (2), make allotments to States and interstate agencies in accordance with such regulations as the Administrator may promulgate, based on the extent of the pollution problem in each State; and notwithstanding any other provision of law, allot to Indian tribes not less than 20 percent. The Administrator may pay to each State, Indian tribe, and interstate agency for each fiscal year an amount equal to the lesser of— the allotment of the State, Indian tribe, or interstate agency for the fiscal year under subsection (b); and the reasonable costs, as determined by the Administrator, of developing and carrying out a pollution program by the State, Indian tribe, or interstate agency during the fiscal year. .
