Section 401 of the Outer Continental Shelf Lands Act Amendments of 1978 ( 43 U.S.C. 1841 ) is amended— by striking the section heading and designation and all that follows through term— in the matter preceding paragraph
(1)and inserting the following: In this title: ; in each of paragraph
(1)through (8)— by inserting The term after the paragraph designation; and by adding a paragraph heading, the text of which comprises the term defined in that paragraph; in each of paragraphs
(1)through (6), by striking the semicolon at the end of the paragraph and inserting a period; in paragraph (1)— in the matter preceding subparagraph (A), by striking area: and inserting area— ; in subparagraph (A), by striking oil or gas and inserting oil, gas, or offshore wind energy ; in subparagraph (B), by striking exploration, development or production and inserting exploration, development, construction, operation, decommissioning, or production ; and in subparagraph (C), by striking pipeline rights-of-way have been granted and inserting rights-of-way have been granted for a pipeline or offshore wind energy transmission ; in paragraph (2), in the matter preceding subparagraph (A), by striking of therein and inserting therein ; in paragraph (7), by striking 402 of this title; and and inserting 402. ; by redesignating paragraph
(8)as paragraph (9); and by inserting after paragraph
(7)the following: The term offshore wind energy means energy produced at a facility that— produces electric energy solely by the use, as the only energy source, of wind; and is located on the outer Continental Shelf. . Section 402(b)(1) of the Outer Continental Shelf Lands Act Amendments of 1978 ( 43 U.S.C. 1842(b)(1) ) is amended, in the first sentence— by striking Act and each holder and inserting Act ( ; and 43 U.S.C. 1331 et seq. ), and each holder by inserting or offshore wind energy after pipeline . Section 403 of the Outer Continental Shelf Lands Act Amendments of 1978 ( 43 U.S.C. 1843 ) is amended— in subsection (a)(2), by inserting and offshore wind energy site characterization and assessment activities, after production activities, ; and in subsection (c)(1), in the first sentence, by inserting , offshore wind energy site characterization and assessment activities, or activities authorized under section 8(p) of the Outer Continental Shelf Lands Act ( after 43 U.S.C. 1337(p) ) production activities . Section 403(c) of the Outer Continental Shelf Lands Act Amendments of 1978 ( 43 U.S.C. 1843(c) ) is amended by adding at the end the following: The Secretary shall ensure— that amounts deposited in the Fund for oil and gas activities shall only be disbursed to compensate claims for oil and gas activities; and that amounts deposited in the Fund for offshore wind energy activities shall only be disbursed to compensate claims for offshore wind energy activities. . Section 404 of the Outer Continental Shelf Lands Act Amendments of 1978 ( 43 U.S.C. 1844 ) is amended, in the matter preceding paragraph (1), by inserting , or offshore wind energy site characterization and assessment activities, as applicable, after production .
