Section 305(b)(5)(B) ( 42 U.S.C. 3025(b)(5)(B) ) is amended to read as follows: Whenever a State agency designates a new area agency on aging after the date of enactment of the Older Americans Act Reauthorization Act of 2024 , the State agency shall give the right to first refusal to a unit of general purpose local government if— such unit can meet the requirements of subsection (c); such unit has demonstrated experience administering services for older individuals; or the State agency determines that there is not another entity eligible under subsection (c)(1) within the planning and service area with such demonstrated experience; and the boundaries of such unit and the boundaries of the planning and service area are reasonably contiguous. .
