Sec. 224. Report on material contaminated by a hazardous substance and the civil works program

Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that describes the impact of material contaminated by a hazardous substance on the civil works program of the Corps of Engineers. In developing the report under subsection (a), the Secretary shall— describe— with respect to water resources development projects— the applicable statutory authorities that require the removal of material contaminated by a hazardous substance; and the roles and responsibilities of the Secretary and non-Federal interests for removing material contaminated by a hazardous substance; and any regulatory actions or decisions made by another Federal agency that impact— the removal of material contaminated by a hazardous substance; and the ability of the Secretary to carry out the civil works program of the Corps of Engineers; discuss the impact of material contaminated by a hazardous substance on— the timely completion of construction of water resources development projects; the operation and maintenance of water resources development projects, including dredging activities of the Corps of Engineers to maintain authorized Federal depths at ports and along the inland waterways; and costs associated with carrying out the civil works program of the Corps of Engineers; include any other information that the Secretary determines to be appropriate to facilitate an understanding of the impact of material contaminated by a hazardous substance on the civil works program of the Corps of Engineers; and propose any legislative recommendations to address any issues identified in paragraphs
(1)through (3).
