The Secretary shall establish a program to carry out appropriate planning, design, and construction measures for wildfire prevention and restoration in the Middle Rio Grande Bosque, including the removal of jetty jacks. Except as provided in paragraph (2), the non-Federal share of the cost of a project carried out under this section shall be in accordance with sections 103 and 105 of the Water Resources Development Act of 1986 ( 33 U.S.C. 2213 , 2215). The non-Federal share of the cost of a project carried out under this section benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note;
Public Law 116–260 )) shall be 10 percent. Section 116 of the Energy and Water Development Appropriations Act, 2004 (117 Stat. 1836), is repealed. The program authorized under subsection
(a)shall be considered a continuation of the program authorized by section 116 of the Energy and Water Development Appropriations Act, 2004 (117 Stat. 1836) (as in effect on the day before the date of enactment of this Act).
