Section 109 of the Foreign Intelligence Surveillance Act of 1978 ( 50 U.S.C. 1809 ) is amended— in subsection (a)— in the matter preceding paragraph (1), by striking intentionally ; in paragraph (1)— by inserting intentionally before engages ; and by striking or at the end; in paragraph (2)— by inserting intentionally before disclose ; and by striking the period at the end and inserting a semicolon; and by adding at the end the following: knowingly submits any document to or makes any false statement before the court established under section 103(a) or the court established under section 103(b), knowing such document or statement to contain— a false material declaration; or a material omission; or knowingly discloses the existence of an application for an order authorizing surveillance under this title, or any information contained therein, to any person not authorized to receive such information, except insofar as such disclosure is authorized by statute or executive order setting forth permissible disclosures by whistleblowers. ; and in subsection (c), by striking five and inserting 8 .
This section and the amendments made by this section may not be construed to interfere with the enforcement of section 798 of title 18, United States Code, or any other provision of law regarding the unlawful disclosure of classified information.
