Sec. 908. Hypersonic pathway to integration study

The Administrator shall conduct a study assessing actions necessary to facilitate the safe operation and integration of hypersonic aircraft into the national airspace system. The study conducted under paragraph
(1)shall include, at a minimum— an initial assessment of cross-agency equities related to hypersonic aircraft technologies and flight; the identification, development, and collection of data required to develop certification, flight standards, and air traffic requirements for the deployment and integration of hypersonic aircraft; the development of a framework and timeline to establish the appropriate regulatory requirements for conducting hypersonic aircraft flights; strategic plans to improve the FAA’s state of preparedness and response capability in advance of receiving applications to conduct hypersonic aircraft flights; and a survey of global hypersonic aircraft-related regulatory and testing developments or activities. In conducting the study under paragraph (1), the Administrator may consider— the feedback and technical expertise of the aerospace industry and other stakeholders when creating policies, regulations, and standards that enable the safe operation and integration of hypersonic aircraft into the national airspace system; opportunities for— demonstrating United States global leadership in aeronautics, including hypersonic aircraft and related technologies; and strengthening global harmonization in aeronautics; and the development of international policies, regulations, and standards relating to the certification and safe operation of hypersonic aircraft. In conducting the study under paragraph (1), the Administrator shall consult with representatives from Federal agencies, industry, and other stakeholders, including— the National Aeronautics and Space Administration; the Department of Defense; aircraft manufacturers; institutions of higher education; and any other stakeholders the Administrator determines appropriate. Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to the appropriate committees of Congress a report on the results of the study conducted under subsection (a), together with recommendations to facilitate the safe operation and integration of hypersonic aircraft into the national airspace system. In this section, the term hypersonic means an aircraft or flight operating at speeds in excess of Mach 5 and above.
