Not later than 180 days after the date of enactment of this section, and to the extent permitted by treaty obligations of the United States, including the Convention on International Civil Aviation, the Administrator shall establish and implement an operational approval process to permit small unmanned aircraft systems (as defined in section 44801 of title 49, United States code), and unmanned aircraft systems (as so defined) with a special airworthiness certificate, to operate over the high seas within flight information regions for which the United States is responsible for the operational control.
In establishing and implementing the approval process under subsection (a), the Administrator shall consult with appropriate stakeholders outside of the FAA, including industry stakeholders.
