Sec. 7. Conveyances of BLM land to the city of Tenakee Springs, Alaska

In this section: The term City means the city of Tenakee Springs, Alaska. The term Federal land means the Bureau of Land Management land depicted on the Survey and more particularly described as— each of lots 1 through 6 of Mineral Springs Reserve No. 1, as depicted on the Survey; each of lots 1 through 3 of Mineral Springs Reserve No. 2, as depicted on the Survey; and each of lots 1 and 2 of Mineral Springs Reserve No. 3, as depicted on the Survey. The term Secretary means the Secretary of the Interior.
The term Survey means the survey prepared by the Bureau of Land Management entitled U.S. Survey No. 1409, Alaska, Dependent Resurvey and Subdivision, Mineral Springs Reserves Nos. 1, 2, and 3 and dated November 16, 2009. Notwithstanding the land use planning requirements of sections 202 and 203 of the Federal Land Policy and Management Act of 1976 ( 43 U.S.C. 1712 , 1713), on written request from the City and subject to the provisions of this subsection, the Secretary shall convey, without consideration, all right, title, and interest of the United States in and to the Federal land.
As a condition of the conveyance of Federal land under paragraph (1)— the City shall offer to the occupant, as of the date of enactment of this Act, of the applicable parcel of Federal land, a right of first refusal to enter into an agreement with the City to lease the applicable parcel of Federal land; and if the occupant, as of the date of enactment of this Act, accepts the offer to enter into a lease agreement with the City for the applicable parcel of Federal land described in subparagraph (A), the lease agreement shall, in accordance with terms established by the City and approved by the City council, be— for a term of not more than 20 years, in the case of a residential lease; and for a term of not more than 99 years, in the case of a nonresidential lease.
As a condition of the conveyance of Federal land under paragraph (1), the City shall pay to the Secretary all costs associated with the conveyance, including the cost of any surveys.
