Subtitle A of title III of the Help America Vote Act of 2002 ( 52 U.S.C. 21081 et seq. ), as amended by section 1031(a), section 1044(a), section 1101(a), section 1102(a), section 1103(a), section 1104(a), section 1201(a), section 1301(a), section 1302(a), section 1303(b), section 1305(a), section 1606(a)(1), and section 1607(a), is amended— by redesignating sections 317 and 318 as sections 318 and 319, respectively; and by inserting after section 316 the following new section:
To the extent that any provision of this title imposes a requirement on a State or jurisdiction relating to contacting voters by telephone, such provision shall not apply in the case of any State which continuously on and after the date of enactment of this Act, does not collect telephone numbers for voters as part of voter registration in the State with respect to an election for Federal office. Subsection
(a)shall not apply in any case in which the voter has voluntarily provided telephone information. . The table of contents of such Act, as amended by section 1031(c), section 1044(b), section 1101(c), section 1102(c), section 1103(a), section 1104(c), section 1201(c), section 1301(a), section 1302(a), section 1303(b), section 1305(a), section 1606(a)(3), and section 1607(b), is amended— by redesignating the items relating to sections 317 and 318 as relating to sections 318 and 319, respectively; and by inserting after the item relating to section 316 the following new item: Sec. 317. Application of certain provisions to States which do not collect telephone information. .
