None of the funds made available by this or any other Act may be used to modify, rescind, or grant waivers from the preemption determinations published by FMCSA at 83 FR 67470 (Dec. 28, 2018) and 85 FR 73335 (Nov. 17, 2020). Notwithstanding 49 U.S.C. 31141(d)(2) , the Secretary shall deny, without a hearing on the record, any petitions for waiver of the aforementioned preemption determinations pending on the date of enactment or received after the date of enactment. Nothing in the Act shall be construed to prohibit the Secretary from modifying, rescinding, or granting a waiver from the preemption determination published by FMCSA at 85 FR 3469 (Jan. 21, 2020).
