Sec. 6612. Appointment of spouses of certain Federal employees

Section 3330d of title 5, United States Code, is amended— in the section heading, by striking and inserting military and Department of Defense civilian spouses ; military and Department of Defense, Department of State, and intelligence community spouses in subsection (a)— by redesignating the second paragraph
(4)(relating to a spouse of an employee of the Department of Defense) as paragraph (7); by striking paragraph (5); by redesignating paragraph
(4)(relating to the spouse of a disabled or deceased member of the Armed Forces) as paragraph (6); by striking paragraph
(3)and inserting the following: The term covered spouse means an individual who is married to an individual who— is an employee of the Department of State or an element of the intelligence community; or is a member of the Armed Forces who is assigned to an element of the intelligence community; and is transferred in the interest of the Government from one official station within the applicable agency to another within the agency (that is outside of normal commuting distance) for permanent duty. The term intelligence community has the meaning given the term in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ). The term remote work refers to a work flexibility arrangement under which an employee— is not expected to physically report to the location from which the employee would otherwise work, considering the position of the employee; and performs the duties and responsibilities of such employee’s position, and other authorized activities, from an approved worksite— other than the location from which the employee would otherwise work; that may be inside or outside the local commuting area of the location from which the employee would otherwise work; and that is typically the residence of the employee. ; and by adding at the end the following: The term telework has the meaning given the term in section 6501. ; and in subsection (b)— in paragraph (2), by striking or at the end; in the first paragraph
(3)(relating to a spouse of a member of the Armed Forces on active duty), by striking the period at the end and inserting a semicolon; by redesignating the second paragraph
(3)(relating to a spouse of an employee of the Department of Defense) as paragraph (4); in paragraph (4), as so redesignated— by inserting , including to a position in which the spouse will engage in remote work after Department of Defense ; and by striking the period at the end and inserting ; or ; and by adding at the end the following: a covered spouse to a position in which the covered spouse will engage in remote work. . The table of sections for subchapter I of chapter 33 of title 5, United States Code, is amended by striking the item relating to section 3330d and inserting the following: 3330d. Appointment of military and Department of Defense, Department of State, and intelligence community civilian spouses. . In this subsection, the term appropriate committees of Congress means— the congressional intelligence committees; the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, and the Committee on Appropriations of the Senate; and the Committee on Armed Services, the Committee on Oversight and Accountability, and the Committee on Appropriations of the House of Representatives. Not later than 5 years after the date of the enactment of this Act, the Director of National Intelligence, the Secretary of State, and the Secretary of Defense shall jointly submit to the appropriate committees of Congress a report detailing the use of the authority provided pursuant to the amendments made by subsection
(a)and the impacts on recruitment, retention, and job opportunities created by such amendments. Nothing in this section or an amendment made by this section shall be construed to revoke or diminish any right of an individual provided by title 5, United States Code. On the date that is 5 years after the date of the enactment of this Act— section 3330d of title 5, United States Code, as amended by subsection (a), is amended to read as it read on the day before the date of the enactment of this Act; and the item for such section in the table of sections for subchapter I of chapter 33 of title 5, United States Code, as amended by subsection (b), is amended to read as it read on the day before the date of the enactment of this Act.
