Sec. 1411. Restoring the National Defense Stockpile

Not later than April 15, 2025, the Secretary of Defense shall submit to the congressional defense committees a plan that includes the following: An identification of the strategic and critical materials for which there is a shortfall in the National Defense Stockpile, as determined by the Secretary, and the estimated cost of resolving such shortfalls. A plan for resolving the shortfalls identified under paragraph
(1)and to avoid any future shortfall in the National Defense Stockpile— with respect to the military and industrial needs of the United States during a national emergency, not later than December 31, 2027; and with respect to the essential civilian needs of the United States during a national emergency, not later than December 31, 2029. A description of the additional funds that would be necessary to resolve the shortfalls identified under paragraph
(1)if the National Defense Stockpile was required to meet the national defense needs of the United States for a period of— not less than two years during a national emergency; and not less than three years during a national emergency. In this section: The term national emergency has the meaning given such term under section 12 of the Strategic and Critical Materials Stock Piling Act ( 50 U.S.C. 98h–3 ). The term strategic and critical materials means materials determined pursuant to section 3(a) of the Strategic and Critical Materials Stock Piling Act ( 50 U.S.C. 98b(a) ) to be strategic and critical materials.
