Sec. 1304. Prohibition on New START Treaty information sharing

None of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2025 for the Department of Defense may be used to provide the Russian Federation with notifications, biannual data exchange, inspection activities, or telemetric activities as required by the New START Treaty. The Secretary of Defense, with concurrence from the Secretary of State, may waive the prohibition in subsection
(a)on a case-by-case basis if the Secretary of Defense certifies to the appropriate congressional committees in writing, that— it is in the national security interest of the United States to unilaterally provide notifications, biannual data exchange, inspection activities, or telemetric information to the Russian Federation; or the Russian Federation is providing similar information to the United States as required by the New START Treaty. In this section— the term appropriate congressional committees means— the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives; and the Committee on Armed Services and the Committee on Foreign Relations of the Senate; and the term New START Treaty means the Treaty between the United States of America and the Russian Federation on Measures for the Further Reduction and Limitation of Strategic Offensive Arms, signed at Prague April 8, 2010, and entered into force February 5, 2011.
