Section 307 of the Federal Election Campaign Act of 1971 ( 52 U.S.C. 30107 ) is amended by adding at the end the following new subsection: Except as provided in paragraph (2), the Commission shall defend each action brought against the Commission under this Act or chapter 95 and 96 of the Internal Revenue Code of 1986— through the general counsel, as provided in subsection (a)(6); by appointing counsel as provided in section 306(f)(4); or by referral to the Attorney General in the case of a criminal action. The Commission may refuse to defend an action brought against the Commission pursuant to the unanimous vote of its Members. . The amendment made by subsection
(a)shall apply with respect to actions brought on or after the date of the enactment of this Act.
