Section 506J(a) of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 356j(a) ) is amended— in paragraph (2), by striking during, or in advance of, a public health emergency ; and in the matter following paragraph (2), by striking , during, or in advance of, a public health emergency declared by the Secretary under section 319 of the Public Health Service Act, .
