The Secretary of State, in consultation with the Secretary of Health and Human Services and the Attorney General, shall use the voice, vote, and influence of the United States at the Conference of the States Parties to the Chemical Weapons Convention to seek to amend the Chemical Weapons Convention to include each covered fentanyl substance on schedule 1, 2, or 3 of the Annex on Chemicals to the Chemical Weapons Convention. Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit to Congress a report on the implementation of this section.
In this section— the term Chemical Weapons Convention means the Convention on the Prohibition of the Development, Production, Stockpiling and use of Chemical Weapons and on their Destruction, done at Paris, January 13, 1993 (commonly known as the Chemical Weapons Convention ); and the term covered fentanyl substance means— fentanyl, including its isomers, esters, ethers, salts, and salts of isomers, esters, and ethers, whenever the existence of such isomers, esters, ethers, and salts is possible within the specific chemical designation (as such terms are used in the Controlled Substances Act ( 21 U.S.C. 801 et seq. )); any controlled substance analogue of fentanyl (as the term controlled substance analogue is defined in section 102(32) of the Controlled Substances Act ( 21 U.S.C. 802(32) ); and any immediate precursor (as defined in section 102(23) of the Controlled Substances Act ( 21 U.S.C. 802(23) ) of fentanyl.
