A State receiving funds under the Elementary and Secondary Education Act of 1965 ( 20 U.S.C. 6301 et seq. ) may not— consider the summative assessments required under section 1111(b)(2) of such Act as a sole or dominant factor when— implementing grade-retention policies; awarding a student a high school diploma; or evaluating the performance of teachers or administrators; establish a rating system for elementary schools or local educational agencies that serve such elementary schools based exclusively on the summative assessment scores of students who attend such elementary schools; or establish a rating system for secondary schools or local educational agencies that serve such secondary schools based exclusively on— the summative assessment scores of students that attend such secondary schools; or the graduation rates of students that attend such secondary schools.
