Sec. 102. Shoreline and riverbank protection and restoration mission

Congress declares that— consistent with the civil works mission of the Corps of Engineers, it is the policy of the United States to protect and restore the shorelines, riverbanks, and streambanks of the United States from the damaging impacts of extreme weather events and other factors contributing to the vulnerability of coastal and riverine communities and ecosystems; the Chief of Engineers shall give priority consideration to the protection and restoration of shorelines, riverbanks, and streambanks from erosion and other damaging impacts of extreme weather events in carrying out the civil works mission of the Corps of Engineers; to the maximum extent practicable, projects and measures for the protection and restoration of shorelines, riverbanks, and streambanks shall be formulated to increase the resilience of such shores and banks from the damaging impacts of extreme weather events and other factors contributing to the vulnerability of coastal and riverine communities and ecosystems using measures described in section 1184(a) of the Water Resources Development Act of 2016 ( 33 U.S.C. 2289a(a) ); and to the maximum extent practicable, periodic nourishment shall be provided, in accordance with subsection
(c)of the first section of the Act of August 13, 1946 (60 Stat. 1056, chapter 960; 33 U.S.C. 426e(c) ), and subject to section 156 of the Water Resources Development Act of 1976 ( 42 U.S.C. 1962d–5f ), for projects and measures carried out for the purpose of restoring and increasing the resilience of ecosystems to the same extent as periodic nourishment is provided for projects and measures carried out for the purpose of coastal storm risk management. Section 212 of the Water Resources Development Act of 1999 ( 33 U.S.C. 2332 ) is amended— in the section heading, by striking and inserting Flood mitigation and riverine restoration program ; Shoreline and riverine protection and restoration by striking subsection
(a)and inserting the following: The Secretary may carry out projects— to reduce flood and coastal storm hazards, including shoreline erosion and riverbank and streambank failures; or to restore the natural functions and values of rivers and shorelines throughout the United States. ; in subsection (b)— by striking paragraph
(1)and inserting the following: The Secretary may carry out studies to identify appropriate measures for— the reduction of flood and coastal storm hazards, including shoreline erosion and riverbank and streambank failures; or the restoration of the natural functions and values of rivers and shorelines. Subject to subsection (f)(2), the Secretary may design and implement projects described in subsection (a). ; in paragraph (3), by striking flood damages and inserting flood and coastal storm damages, including the use of measures described in section 1184(a) of the Water Resources Development Act of 2016 ( ; and 33 U.S.C. 2289a(a) ) in paragraph (4)— by inserting and coastal storm after flood ; by inserting , shoreline, after riverine ; and by inserting and coastal barriers after floodplains ; in subsection (c)— by striking paragraph
(1)and inserting the following: Subject to subparagraph (B), the non-Federal share of the cost of a study under this section shall be— 50 percent; and 10 percent, in the case of a study benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note; Public Law 116–260 )). The first $100,000 of the costs of a study under this section shall be at full Federal expense. ; and in paragraph (2)— in the paragraph heading, by striking ; and flood control by striking subparagraph
(A)and inserting the following: Design and construction of a nonstructural measure or project, a measure or project described in section 1184(a) of the Water Resources Development Act of 2016 ( 33 U.S.C. 2289a(a) ), or for a measure or project for environmental restoration, shall be subject to cost sharing in accordance with section 103 of the Water Resources Development Act of 1986 ( 33 U.S.C. 2213 ), except that the non-Federal share of the cost to design and construct a project benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note; Public Law 116–260 )) shall be 10 percent. ; and in paragraph (3)— in the paragraph heading, by striking and inserting control ; and coastal storm risk management by striking control and inserting and coastal storm risk management ; and by striking section 103(a) of the Water Resources Development Act of 1986 ( and inserting 33 U.S.C. 2213(a) ) section 103 of the Water Resources Development Act of 1986 ( ; 33 U.S.C. 2213 ), except that the non-Federal share of the cost to design and construct a project benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note; Public Law 116–260 )) shall be 10 percent in subsection (d)— by striking paragraph (2); by striking the subsection designation and heading and all that follows through Notwithstanding in paragraph
(1)in the matter preceding subparagraph
(A)and inserting the following: Notwithstanding ; by redesignating subparagraphs

(C)as paragraphs
(1)through (3), respectively, and indenting appropriately; and in paragraph

(A)through (GG), respectively, and indenting appropriately; in the matter preceding subparagraph
(A)(as so redesignated), by striking In carrying out and inserting the following: In carrying out ; and by adding at the end the following: In carrying out this section after the date of enactment of the Water Resources Development Act of 2022 , the Secretary shall prioritize projects for the following locations: Delaware beaches and watersheds, Delaware. Louisiana Coastal Area, Louisiana. Great Lakes Shores and Watersheds. Oregon Coastal Area, Oregon. Upper Missouri River Basin. Ohio River Tributaries and their watersheds, West Virginia. Chesapeake Bay watershed and Maryland beaches, Maryland. ; by striking subsections (f), (g), and (i); by redesignating subsection
(h)as subsection (f); and in subsection
(f)(as so redesignated), by striking paragraph
(2)and inserting the following: The Secretary shall not carry out a project until Congress enacts a law authorizing the Secretary to carry out the project, if the Federal share of the cost to design and construct the project exceeds— $26,000,000, in the case of a project benefitting an economically disadvantaged community (as defined pursuant to section 160 of the Water Resources Development Act of 2020 ( 33 U.S.C. 2201 note; Public Law 116–260 )); $23,000,000, in the case of a project other than a project benefitting an economically disadvantaged community (as so defined) that— is for purposes of environmental restoration; or derives not less than 50 percent of the erosion, flood, or coastal storm risk reduction benefits from nonstructural measures or measures described in section 1184(a) of the Water Resources Development Act of 2016 ( 33 U.S.C. 2289a(a) ); or $18,500,000, for a project other than a project described in subparagraph
(A)or (B). . The table of contents in section 1(b) of the Water Resources Development Act of 1999 (113 Stat. 269) is amended by striking the item relating to section 212 and inserting the following: Sec. 212. Shoreline and riverine protection and restoration. . Section 14 of the Flood Control Act of 1946 ( 33 U.S.C. 701r ) is amended by striking $5,000,000 and inserting $10,000,000 .
