During fiscal year 2022, the United States should give priority to the delivery of excess defense articles to Ukraine over the transfer of such articles to other countries and regions under section 516(c)(2) of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2321j(c)(2) ). The President may waive subsection
(a)if the President certifies to the appropriate congressional committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives, that such a waiver is in the national security interest of the United States.
