In this Act: The term deficient program means a program identified by the head of a Federal agency under section 4(c). The term domestic content procurement preference means a requirement that no amounts made available through a program for Federal financial assistance may be obligated for a project unless— all iron and steel used in the project are produced in the United States; or the manufactured products used in the project are produced in the United States. The term Federal agency has the meaning given the term agency in section 552(f) of title 5, United States Code.
The term Federal financial assistance has the meaning given the term in section 200.40 of title 2, Code of Federal Regulations (or successor regulations). The term Federal financial assistance includes all expenditures by a Federal agency for an infrastructure project. The term infrastructure includes, at a minimum, the structures, facilities, and equipment for, in the United States— roads, highways, and bridges; public transportation; dams, ports, harbors, and other maritime facilities; intercity passenger and freight railroads; freight and intermodal facilities; airports; water systems, including drinking water and wastewater systems; electrical transmission facilities and systems; utilities; broadband infrastructure; and buildings and real property.
The term produced in the United States means, in the case of iron or steel products, that all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States. The term project means the construction, alteration, maintenance, or repair of infrastructure in the United States.
