Section 112 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 ( 25 U.S.C. 1812 ) is amended to read as follows: The Secretary shall conduct a study on the condition of facilities of tribally controlled colleges or universities, including facilities of Tribal Colleges or Universities (as defined in section 316(b) of the Higher Education Act of 1965 ( 20 U.S.C. 1059c(b) )). The study under paragraph
(1)shall identify the need for new construction, renovation, and infrastructure enhancements of the Tribal Colleges and Universities. The Secretary may conduct the study required in subsection
(a)directly or by contract. Not later than 18 months after the date of enactment of the Honoring Promises to Native Nations Act , the Secretary shall submit a report describing the results of the study under subsection
(a)to— the Committee on Indian Affairs of the Senate; the Subcommittee for Indigenous Peoples of the United States of the Committee on Natural Resources of the House of Representatives; the Committee on Appropriations of the Senate; and the Committee on Appropriations of the House of Representatives. . Section 113 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 ( 25 U.S.C. 1813 ) is amended to read as follows: In this section: The term construction includes any measure to address a facility construction, maintenance, renovation, reconstruction, or replacement need of a Tribal College or University. The term Tribal College or University means a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 ( 20 U.S.C. 1059c(b) )) that was in operation as such a Tribal College or University— during fiscal year 2022; or for a period of not fewer than 4 consecutive fiscal years through an affiliation with a tribally controlled college or university that received assistance under this title during fiscal year 2022. Subject to the availability of appropriations, the Secretary shall provide to a Tribal College or University the application of which is approved under subsection
(c)a grant for construction in accordance with this section. To be eligible to receive a grant under this section, a Tribal College or University shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may reasonably require. The Secretary shall approve an application submitted under paragraph
(1)if the Secretary determines that— the application meets all applicable requirements established by the Secretary; and identifies a need for construction at the Tribal College or University. A Tribal College or University shall use a grant provided under this section to address facilities and infrastructure needs, including— construction of new facilities, including— classrooms; administrative offices; libraries; health, fitness, and cultural centers; child care centers; technology centers; housing for students, faculty, and staff; and other facilities necessary to an institution of higher education; renovating or expanding an existing or acquired facility; providing new or existing facilities with equipment and infrastructure, including— laboratory equipment; computer infrastructure and equipment; broadband infrastructure and equipment; library books; and furniture; and property acquisition. A Tribal College or University that receives a grant under this section shall not be required to make a matching contribution for any Federal amounts received. There is authorized to be appropriated to carry out this section $525,000,000 for each of fiscal years 2023 through 2025. . Section 110(a)(3) of the Tribally Controlled Colleges and Universities Assistance Act of 1978 ( 25 U.S.C. 1810(a)(3) ) is amended by striking sections 112(b) and 113 and inserting section 112(b) .
