Section 2 of the Commodity Exchange Act ( 7 U.S.C. 2 ) is amended— in subsection (a)(1)(A), in the first sentence, by striking section 19 of this Act and inserting subsection (c)(2)(F) or section 19 ; and in subsection (c)(2), by adding at the end the following: Except as provided in clause (ii), this Act applies to, and the Commission shall have exclusive jurisdiction over, any account, agreement, contract, or transaction involving a digital commodity trade. Nothing in this Act applies to, and the Commission shall not have jurisdiction over, any digital commodity transaction by a merchant or consumer that uses a digital commodity solely for the purchase or sale of a good or service.
Sections 4b, 4c, and 6(c) shall apply to any digital commodity trade as if the digital commodity trade were a contract of sale of a commodity for future delivery. .
