The Secretary of Housing and Urban Development shall conduct such surveys, on an annual basis, as necessary to determine the levels of discrimination in housing practices throughout the United States on the basis of protected classes under the Fair Housing Act ( 42 U.S.C. 3601 et seq. ), including single, partnered, and married persons’ sexual orientation or gender identity (in this section referred to as SOGI ), or both. Data shall be collected in a manner to identify the intersectionalities of protected characteristics under the Fair Housing Act identified by survey participants with other protected characteristics, as well as age (disaggregated in increments of 5 years of age).
Not later than June 1 of each calendar year, the Secretary shall submit a report to the Congress, and make such report publicly available on a website of the Department of Housing and Urban Development, setting forth the findings of the Secretary, with respect to levels of discrimination occurring in the preceding calendar year, as determined by the surveys conducted for such preceding year. For purposes of this section, the following definitions shall apply: The term gender identity means, with respect to an individual, such individual’s sense of being male, female, transgender, or another gender, as distinct from the individual’s sex assigned at birth.
The term sexual orientation means, with respect to an individual, how such individual identifies in terms of their emotional, romantic, or sexual attractions, and includes identification as straight, heterosexual, gay, lesbian, or bisexual, among other identifications.
