Sec. 804. Life cycle management and product support

Section 4324(b) of title 10, United States Code, is amended— by designating the matter preceding subparagraph (A), as so redesignated, as paragraph (1); by redesignating paragraphs (1), (2), (3), (4), (5), (6), (7), and
(8)as subparagraphs (A), (B), (C), (D), (E), (F), (G), and (I), respectively; in paragraph (1), as so designated— in the matter preceding subparagraph (A), as so redesignated— by inserting before In general.— Before granting ; and by inserting after approved life cycle sustainment plan the following: approved by all covered individuals for such covered system ; by amending subparagraph (G), as so redesignated, to read as follows: an intellectual property management plan for product support, including access to technical data and computer software, as well as contract delivery requirements for the data rights; ; by inserting after subparagraph (G), as so redesignated, the following new subparagraph: an estimate of the number of personnel needed to operate and maintain the covered system; ; in subparagraph (I), as so redesignated, by striking the period at the end and inserting ; and at the end; and by inserting after subparagraph (I), as so redesignated, the following new subparagraph: a product support business case analysis that— addresses— the costs, benefits, and risks to sustainment associated with the performance goals; the engineering and design considerations; intellectual property, including access to technical data and computer software; and the number of personnel needed to operate and maintain the covered system; and explicitly addresses— the tradeoffs made between the factors described in clause (i); and the associated implications of such tradeoffs for— design, development, production, and operating and support costs; operational and materiel availability; the mix of active and reserve components of the military, Government civilian employee, host nation support, and contractor personnel to operate and maintain the covered system; and the ability of the Government to retain core logistics capability identified under section 2464 and comply with the requirements under section 2466. ; and by adding at the end the following new paragraphs: Before granting approval for entry of the covered system into each subsequent phase of the acquisition after the phase described in section 4172(e)(7), the milestone decision authority shall ensure that the life cycle sustainment plan described in paragraph
(1)for such covered system has been updated and again approved by all covered individuals for such covered system. In this subsection, the term covered individuals means— a product support manager described in subsection (c); a program manager (as defined in section 1737(a)); a program executive officer (as defined in section 1737(a)); and an appropriate materiel, logistics, or fleet representative. .
