Section 1403 of the Virginia Graeme Baker Pool and Spa Safety Act ( 15 U.S.C. 8002 ) is amended— by redesignating paragraphs (4), (5), (6), (7), and
(8)as paragraphs (6), (8), (9), (10), and (11), respectively; by inserting after paragraph
(3)the following: The term covered entity means— a State; an Indian Tribe; or a nonprofit organization. The term Indian Tribe has the meaning given the term Indian tribe in section 102 of the Federally Recognized Indian Tribe List Act of 1994 ( 25 U.S.C. 5130 ). ; and by inserting after paragraph
(6)(as so redesignated) the following: The term nonprofit organization means an organization that— is described in section 501(c)(3) of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code; and has proven experience (as determined by the Commission) dealing in swimming pool or spa safety and drowning prevention. . (11)of section 1403 of the Virginia Graeme Baker Pool and Spa Safety Act (as so redesignated) is amended by striking section 3(10) of the Consumer Product Safety Act ( and inserting 15 U.S.C. 2052(10) ) section 3(a) of the Consumer Product Safety Act ( . 15 U.S.C. 2052(a) )
