Sec. 401. Pediatric mental health care access grants

Section 330M of the Public Health Service Act ( 42 U.S.C. 254c–19 ) is amended— in the section enumerator, by striking and inserting 330M ; 330M. in subsection (a)— by striking Indian tribes and tribal organizations and inserting Indian Tribes and Tribal organizations ; and by inserting or, in the case of a State that does not submit an application, a nonprofit entity that has the support of the State after 450b)) ; in subsection (b)— in paragraph (1)— in subparagraph (G), by inserting developmental-behavioral pediatricians, after adolescent psychiatrists, ; in subparagraph (H), by striking ; and at the end and inserting a semicolon; by redesignating subparagraph
(I)as subparagraph (J); and by inserting after subparagraph
(H)the following: maintain an up-to-date list of community-based supports for children with mental health problems; and ; by redesignating paragraph
(2)as paragraph (4); by inserting after paragraph
(1)the following: In addition to the activities required by paragraph (1), a pediatric mental health care telehealth access program referred to in subsection (a), with respect to which a grant under such subsection may be used, may provide support to schools and emergency departments. In awarding grants under this section, the Secretary shall give priority to applicants proposing to— continue existing programs that meet the requirements of paragraph (1); establish a pediatric mental health care telehealth access program in the jurisdiction of a State, Territory, Indian Tribe, or Tribal organization that does not yet have such a program; or expand a pediatric mental health care telehealth access program to include one or more new sites of care, such as a school or emergency department. ; and in paragraph (4), as redesignated by subparagraph (B), by inserting Such a team may include a developmental-behavioral pediatrician. after mental health counselor. ; in subsections (c), (d), and (f), by striking Indian tribe, or tribal organization each place it appears and inserting Indian Tribe, Tribal organization, or nonprofit entity ; and by striking subsection
(g)and inserting the following: The Secretary shall award grants or contracts to one or more eligible entities (as defined by the Secretary) for the purposes of providing technical assistance and evaluation support to grantees under subsection (a). To carry out this section, there are authorized to be appropriated— $14,000,000 for each of fiscal years 2023 through 2025; and $30,000,000 for each of fiscal years 2026 through 2027. .
