The Secretary of Agriculture shall revise section 3.91(b)(1)(lvi) of title 7, Code of Federal Regulations (or a successor regulation), to establish a maximum civil penalty of $86,156, which shall be adjusted for inflation in the same manner and to the same extent as civil monetary penalties under the Federal Civil Penalties Inflation Adjustment Act of 1990 ( 28 U.S.C. 2461 note).
