Section 6610 of the Damon Paul Nelson and Matthew Young Pollard Intelligence Authorization Act for Fiscal Years 2018, 2019, and 2020 ( 50 U.S.C. 3352e ) is amended— by striking this Act and not less frequently than once every 5 years thereafter, and inserting this Act, and biennially thereafter, ; and by adding at the end the following new sentence: Such report shall take into account the potential effect of maintaining continuity of operations during a covered national emergency (as defined by section 303 of the Intelligence Authorization Act for Fiscal Year 2021 (division W of .
Public Law 116–260 )) and the assessed needs of the intelligence community to maintain such continuity of operations.
