In promulgating the regulations required by section 18, the Secretary of Health and Human Services shall include requirements for the format of the information required under section 403(i) of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 343(i) )— for the purpose of improving the readability of such information on the label of the food (other than a dietary supplement); and that are, as determined by the Secretary, necessary to assist consumers in maintaining healthy dietary practices. The format requirements referred to in subsection
(a)shall include requirements for font size, uppercase and lowercase characters, serif and noncondensed font types, high-contrast between text and background, and bullet points between adjacent ingredients with appropriate exemptions for small packages or other considerations. Not later than 2 years after the enactment of this Act, and every 2 years thereafter, the Secretary of Health and Human Services shall submit a report to the Congress on the Secretary’s enforcement of— section 403(i) of the Federal Food, Drug, and Cosmetic Act ( 21 U.S.C. 343(i) ), as amended pursuant to subsection (a); and regulations of the Food and Drug Administration on labeling of ingredients in section 101.4 of title 21, Code of Federal Regulations.
