Section 203 of the Child Abuse Prevention and Treatment Act ( 42 U.S.C. 5116b ) is amended— by striking subsection
(a)and inserting the following: For the purpose of making allotments to Indian tribes and tribal organizations and migrant programs, the Secretary shall reserve 5 percent of the amount appropriated under section 210(a) for each fiscal year, except that, if making such reservation would cause the total amount allotted to States under this section for a fiscal year to be less than such total for fiscal year 2021, the Secretary shall reserve 1 percent of the amount appropriated under section 210(a) for the year for such purpose. ; and by adding at the end the following: For any fiscal year for which the amount allotted to a State under subsection
(b)exceeds the amount allotted to the State under such subsection for fiscal year 2021, the State’s lead entity may use not more than 10 percent of such excess amount for administrative expenses. .
