Section 1101 of the Families First Coronavirus Response Act ( 7 U.S.C. 2011 note; Public Law 116–127 ) is amended— in subsection (a)— by striking During fiscal years 2020 and 2021 and inserting In any school year in which there is a public health emergency designation ; and by inserting or in a covered summer period following a school session after in session ; in subsection (g), by striking During fiscal year 2020, the and inserting The ; in subsection (h)(1)— by inserting either after at least 1 child enrolled in such a covered child care facility and ; and by inserting or a Department of Agriculture grant-funded nutrition assistance program in the Commonwealth of the Northern Mariana Islands, Puerto Rico, or American Samoa before shall be eligible to receive assistance ; by redesignating subsections

(j)and (k), respectively; by inserting after subsection
(h)the following: The Secretary of Agriculture may permit a State agency to extend a State agency plan approved under subsection
(b)for not more than 90 days for the purpose of operating the plan during a covered summer period, during which time schools participating in the school lunch program under the Richard B. Russell National School Lunch Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 ( 42 U.S.C. 1773 ) and covered child care facilities shall be deemed closed for purposes of this section. ; in subsection
(j)(as so redesignated)— by redesignating paragraphs
