Not later than 45 days after enactment of this Act, each department, agency, or organization funded in titles I, II, and VI of this Act, and the Department of the Treasury and Independent Agencies funded in title III of this Act, including the Inter-American Foundation and the United States African Development Foundation, shall submit to the Committees on Appropriations an operating plan for funds appropriated to such department, agency, or organization in such titles of this Act, or funds otherwise available for obligation in fiscal year 2020, that provides details of the uses of such funds at the program, project, and activity level: , That such plans shall include, as applicable, a comparison between the congressional budget justification funding levels, the most recent congressional directives or approved funding levels, and the funding levels proposed by the department or agency; and a clear, concise, and informative description/justification:
Provided , That operating plans that include changes in levels of funding for programs, projects, and activities specified in the congressional budget justification, in this Act, or amounts specifically designated in the respective tables included in the report accompanying this Act, as applicable, shall be subject to the notification and reprogramming requirements of section 7011 of this Act. Provided further Prior to the initial obligation of funds but not later than 120 days after enactment of this Act, the Secretary of State or Administrator of the United States Agency for International Development, as appropriate, shall submit to the Committees on Appropriations a spend plan for funds made available by this Act, for:
Assistance for Afghanistan, Iraq, Lebanon, Pakistan, Syria, the West Bank and Gaza, Colombia, and countries in Central America. Assistance made available pursuant to section 7037(d) of this Act to counter Russian influence and aggression, except that such plan shall be on a country-by-country basis. Assistance made available pursuant to section 7046 of this Act. The Indo-Pacific Strategy. Democracy programs, Power Africa, programs to support section 7041(a) of this Act, and sectors enumerated in subsections (a),
(c)(except funds that are made available for the United States Forest Service, the United States Fish and Wildlife Service, and the Department of Interior for the purposes specified in the table under this heading in the report accompanying this Act), (d), (e), (f), (g), and
(h)of section 7047 of this Act. Funds provided under the heading International Narcotics Control and Law Enforcement Affairs for International Organized Crime and for Cybercrime and Intellectual Property Rights: , That the spend plans shall include bilateral and global programs funded under such heading along with a brief description of the activities planned for each country. Provided The regional security initiatives described under this heading in the report accompanying this Act. Notwithstanding paragraph (1), up to 10 percent of the funds contained in a spend plan required by this subsection may be obligated prior to the submission of such spend plan if the Secretary of State or the USAID Administrator, as appropriate, determines that the obligation of such funds is necessary to avoid significant programmatic disruption: , That not less than seven days prior to such obligation, the Secretary or Administrator, as appropriate, shall consult with the Committees on Appropriations on the justification for such obligation and the proposed uses of such funds. Provided The Secretary of State and the USAID Administrator, as appropriate, may submit partial spend plans to the Committees on Appropriations to meet the requirements of this subsection or any similar provision in this Act only following consultation with such Committees: , That any partial spend plan shall clearly identify— Provided any amount remaining to be submitted for the required spend plan; any amount previously submitted for the required spend plan; and any actual or projected changes to the total required spend plan amount. Not later than 45 days after enactment of this Act, the USAID Administrator shall submit to the Committees on Appropriations a detailed report on spending of funds made available during fiscal year 2019 under the heading Development Credit Authority . The spend plans referenced in subsection
(b)shall not be considered as meeting the notification requirements in this Act or under section 634A of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2394–1 ). The congressional budget justification for Department of State operations and foreign operations shall be provided to the Committees on Appropriations concurrent with the date of submission of the President’s budget for fiscal year 2021: , That the appendices for such justification shall be provided to the Committees on Appropriations not later than 10 calendar days thereafter. Provided The Secretary of State and the USAID Administrator shall include in the congressional budget justification a detailed justification for multi-year availability for any funds requested under the headings Diplomatic Programs and Operating Expenses .
