Sec. 1236. Limitation on transfer of F–35 aircraft to the Republic of Turkey

Except as provided in subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for the Department of Defense may be used to do the following: Transfer, or facilitate the transfer of, F–35 aircraft to the territory of the Republic of Turkey. Transfer equipment, intellectual property, or technical data necessary for or related to the maintenance or support of the F–35 aircraft in the territory of the Republic of Turkey. Construct facilities for or otherwise associated with the storage of F–35 aircraft in the territory of the Republic of Turkey.
The Secretary of Defense, with the concurrence of the Secretary of State, may waive the limitation under subsection
(a)if the Secretary of Defense and the Secretary of State submit to the congressional defense committees, the Committee on Foreign Relations of the Senate, and the Committee on Foreign Affairs of the House of Representatives a certification that the Government of Turkey— has not accepted delivery of the S–400 air and missile defense system from the Russian Federation; and has provided reliable assurances that the Government of Turkey will not accept delivery of the S–400 air and missile defense system from the Russian Federation in the future.
