Section 4003 of the CARES Act is amended by adding at the end the following: Any person harmed by a violation of the terms and conditions of subsection
(c)of an eligible business may bring an action in an appropriate district court of the United States. The court may award a plaintiff who prevails in an action under subparagraph
(A)a portion of any fine imposed on an eligible business for a violation of the terms and conditions of subsection (c). The Secretary or the Special Inspector General for Pandemic Recovery shall require disgorgement from any senior executive of an eligible business that receives a loan, loan guarantee, or other investment authorized under this section that violates the terms and conditions established under subsection (c). .
