Sec. 106. Elimination of Social Security disability and Medicare waiting periods

During the period that begins on the date of enactment of this Act and ends on the last day of the sixth month that begins on or after the last day of the public health emergency described in section 1135(g)(1)(B) of the Social Security Act ( 42 U.S.C. 1320b–5(g)(1)(B) )— section 202(e)(5) of the Social Security Act ( 42 U.S.C. 402(e)(5) ) shall be applied by striking subparagraphs
(A)and
(B)and inserting the following: The waiting period referred to in paragraph (1)(F), in the case of any widow or surviving divorced wife, is zero months. ; section 202(f)(5) of the Social Security Act ( 42 U.S.C. 402(f)(5) ) shall be applied by striking subparagraphs
(A)and
(B)and inserting the following: The waiting period referred to in paragraph (1)(F), in the case of any widower or surviving divorced husband, is zero months. ; section 223(c)(2) of the Social Security Act ( 42 U.S.C. 423(c)(2) ) shall be applied by substituting zero months. for the earliest period of five consecutive calendar months and all that follows through the period; and section 5(a)(ii) of the Railroad Retirement Act of 1974 (45 U.S.C. 231c(a)(ii)) shall be applied by striking the of
(A)and all that follows through
(B). For purposes of applying section 226 of the Social Security Act ( 42 U.S.C. 426 ) to any individual during the period described in subsection (a), the following special rules apply: Subsection
(b)of such section shall be applied as if there were no requirement for any entitlement to benefits, or status, for a period longer than 1 month. The entitlement under such subsection shall begin with the first month (rather than twenty-fifth month) of entitlement or status. Subsection
(f)of such section shall not be applied. The provisions of the Social Security Act and the Railroad Retirement Act of 1974 specified in subsections
(a)and
(b)shall be applied in the manner described in such subsections with respect to any individual— for whom a waiting period under such provision began before the date of enactment of this Act; and for whom a waiting period under such a provision begins on or after such date of enactment. An individual with respect to whom a waiting period under a provision specified in subsection
(a)or
(b)does not apply as a result of the application of such subsection shall, for purposes of applying such provision to such individual after the end of the period described in subsection (a), be deemed to have met the waiting period requirement under such provision.
