Notwithstanding any other provision of law and except as provided in subsection (b), during the COVID–19 emergency period, the Commissioner shall not make any downward adjustment to a benefit amount payable to an individual under title II or XVI of the Social Security Act ( 42 U.S.C. 401 et seq., 1381 et seq.), or take any other action, for the purpose of collecting an overpayment made to such individual. Subsection
(a)shall not apply to any downward adjustment or any other action with respect to a benefit amount payable to an individual under title II or XVI of the Social Security Act ( 42 U.S.C. 401 et seq., 1381 et seq.) if such adjustment is made, or such action taken, on the basis that the individual is involved in fraud or similar fault.
