Notwithstanding any other provision of law and except as provided in subsection (b), the Commissioner shall not conduct any continuing disability review (as such term is defined in section 201(g)(1)(A) of the Social Security Act ( 42 U.S.C. 401(g)(1)(A) )) during the COVID–19 emergency period. Subsection
(a)shall not apply to a continuing disability review that— is in progress on the date of enactment of this Act; and is being conducted pursuant to an appeal by an individual of a adverse decision of the Commissioner with respect to the individual's eligibility for benefits under title II or XVI of the Social Security Act ( 42 U.S.C. 401 et seq., 1381 et seq.), or the amount of such benefits for which the individual is eligible.
