Section 7321 of the PFAS Act of 2019 ( Public Law 116–92 ) is amended— in subsection (b), by adding at the end the following: Section 372.38 of title 40, Code of Federal Regulations (or any successor regulation), shall not apply to a chemical described in paragraph
(1)unless the Administrator, in accordance with paragraph (2)(B), revises the threshold for reporting such chemical to 10,000 pounds. ; in subsection (c), by adding at the end the following: Section 372.38 of title 40, Code of Federal Regulations (or any successor regulation), shall not apply to the substances and classes of substances included in the toxics release inventory under paragraph
(1)unless the Administrator, in accordance with paragraph (2)(B), revises the threshold for reporting such substances and class of substances to 10,000 pounds. ; and in subsection (d), by adding at the end the following: Section 372.38 of title 40, Code of Federal Regulations (or any successor regulation), shall not apply to the substances and classes of substances described in paragraph
(2)unless the Administrator sets a 10,000 pound reporting threshold for such substances and classes of substances. .
