Section 830 of the National Defense Authorization Act for Fiscal Year 2017 ( 22 U.S.C. 2762 note) is amended— in subsection (a), by inserting and subject to subsection
(e)after enactment of this Act ; and by adding at the end the following new subsection: The regulations prescribed pursuant to subsection
(a)shall not apply to a foreign military sale for which the foreign country that is the counterparty to such foreign military sale has requested a modification to the defense service or defense article that is the subject of such foreign military sale that would require significant development work. ; and in subsection (c), by adding at the end the following new sentence: The Secretary may not delegate the authority to exercise such a waiver below the level of the service acquisition executive (as defined in section 101(a)(10) of title 10, United States Code). . The Secretary of Defense shall— not later than 120 days after the date of the enactment of this Act, issue guidance to carry out the amendments made by this section; and not later than February 1, 2021, revise the Department of Defense Supplement to the Federal Acquisition Regulation to carry out the amendments made by this section.
