Sec. 1049. Limitation on use of funds pending public availability of top-line numbers of deployed members of the Armed Forces

Of the amounts authorized to be appropriated by this Act or otherwise made available for fiscal year 2020 for Operation and Maintenance, Defense-wide, Office of the Secretary of Defense, for Travel of Persons, not more than 75 percent may be obligated or expended until the date on which the Secretary of Defense makes publicly available the top-line numbers of deployed members of the Armed Forces described in subsection (b). The top-line numbers of deployed members of the Armed Forces referred to in subsection (a)— are the numbers required to be made publicly available under section 595 of the John S.
McCain National Defense Authorization Act for Fiscal Year 2019 ( Public Law 115–232 ; 10 U.S.C. 122a note); shall include all such numbers for fiscal year 2017 and each subsequent fiscal year; and shall include the number of personnel on temporary duty and the number of personnel deployed in support of contingency operations. The requirement under subsection
(a)to make the top-line numbers of deployed members of the Armed Forces publicly available is not satisfied if the Secretary, in exercising the waiver authority under subsection
(b)of section 595 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 ( Public Law 115–232 ; 10 U.S.C. 122a note) does not submit the notice and reasons for the waiver determination to Committees of Armed Services of the House of Representatives and the Senate as required under paragraph
(2)of such subsection.
