Section 501(g)(2) of the Foreign Intelligence Surveillance Act of 1978 ( 50 U.S.C. 1861(g)(2) ) is amended— in subparagraph (B), by striking and at the end; by redesignating subparagraph
(C)as subparagraph (D); by inserting after subparagraph
(B)the following new subparagraph (C): procedures that require that nonpublicly available information shall not be retained for more than three years unless determined to include foreign intelligence information; and ; and in subparagraph (D), as redesignated by paragraph (2), by striking and
(B)and inserting (B), and
(C).
