Sec. 903. Prohibition on assistance to governments supporting international terrorism

Subsection
(a)of section 620A of the Foreign Assistance Act of 1961 ( 22 U.S.C. 2371 ) is amended by striking that the government of that country and all that follows and inserting that the government of that country— has repeatedly provided support for acts of international terrorism; grants sanctuary from prosecution to any individual or group which has committed an act of international terrorism; otherwise supports international terrorism; or is controlled by an organization designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act ( 8 U.S.C. 1189 ). . Subsection
(c)of such section is amended by striking and the Chairman of the Committee on Foreign Relations of the Senate and inserting , the Committee on Foreign Affairs of the House of Representatives, the Committee on Foreign Relations of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate . Subsection (d)(2) of such section is amended by striking and the chairman of the Committee on Foreign Relations of the Senate and inserting , the Committee on Foreign Affairs of the House of Representatives, the Committee on Foreign Relations of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate . Such section, as so amended, is further amended by adding at the end the following: The United States shall not provide any assistance under this Act or section 23 of the Arms Export Control Act to any foreign government that provides lethal military equipment to a country the government of which the Secretary of State has determined supports international terrorism for purposes of section 1754(c) of the Export Control Reform Act of 2018. The prohibition on assistance under subparagraph
(A)with respect to a foreign government shall terminate 12 months after such government ceases to provide the lethal military equipment described in such subparagraph. This subsection applies with respect to lethal military equipment provided under a contract entered into after October 1, 1997. The President may waive the prohibition on assistance under paragraph
(1)with respect to a foreign government if the President determines that to do so is important to the national interest of the United States. Upon the exercise of the waiver authority pursuant to paragraph (2), the President shall submit to the appropriate congressional committees a report with respect to the furnishing of assistance under the waiver authority, including— a detailed explanation of the assistance to be provided; the estimated dollar amount of such assistance; and an explanation of how the assistance furthers the national interest of the United States. In this subsection, the term appropriate congressional committees means— the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives; and the Committee on Foreign Relations and the Committee on Appropriations of the Senate. .
